No. A prototype is never required to file a patent application or to speak with Eric. What matters is that you can describe your invention clearly. If you can explain what it is, how it works, and what makes it different from existing products, you are ready to call.
Yes. Everything you share with Eric during the consultation is protected by attorney-client privilege from the moment you make contact. Your invention details are completely confidential regardless of whether you proceed with filing.
A provisional application typically costs $1,500 to $6,500 depending on complexity. A utility patent costs $5,000 to $8,500 plus USPTO filing fees averaging $910. A design patent typically runs $2,500 to $4,500. Eric gives you a precise estimate on the call based on your specific invention.
If you decide to move forward, Eric can typically begin drafting within days. A provisional application can be filed within a week or two. A full utility application takes longer to draft properly. If you have a deadline (a trade show, public disclosure, or investor meeting), tell Eric on the call and he will prioritize accordingly.
Yes. Eric handles C&D reviews as a separate flat-fee service ($3,500). If you have received a C&D letter alleging patent infringement, book a call immediately. Eric will review the letter, assess your actual risk level, and tell you exactly how to respond. Do not ignore it and do not respond without legal analysis.
